FlowChinese Terms of Service

Welcome to FlowChinese. These Terms of Service are an agreement between you and the operators of FlowChinese regarding the downloading, access and use of the FlowChinese App and related services.

Please read these Terms and the FlowChinese Privacy Policy carefully before using FlowChinese. If you do not agree to these terms, please stop using this App or related services.

1. Service content

FlowChinese provides Chinese learning related functions, including but not limited to:

• Scenario Chinese courses;
• Pinyin, Chinese characters and pronunciation learning;
• Chinese culture and news content;
• Photo translation, text translation and voice translation;
• AI coaching and conversation practice;
• Voice assessment and speaking exercises;
• Learning progress, membership rights, points and in-app messages;
• Subscription membership and points purchase.

Specific functions may vary depending on region, language, device, system version, account status, membership level, points balance or server configuration.

2. Account and login

You can log in using Apple login, Google login or email verification code. You should ensure that the information you provide is true, accurate, and complete, and keep your account and device properly.

You shall be solely responsible for any losses caused by your failure to properly keep your account, verification code, device or system permissions, unless otherwise provided by applicable law.

If we find that your account has security risks, violates these terms, is suspected of violating laws and regulations, or affects the normal use of services by other users, we may restrict, suspend or terminate related services within a reasonable scope.

3. Usage rules

You agree not to use FlowChinese to:

• Violate applicable laws, regulations, regulatory requirements or third-party rights;
• Upload, input or transmit illegal, infringing, fraudulent, harassing, hateful, pornographic, violent or other inappropriate content;
• Attempt to attack, interfere with, reverse engineer, crack, crawl or abuse the App, servers, interfaces or third-party services;
• Pretend to use another person's identity or access other people's accounts without authorization;
• Use the Services in an automated, bulk, unusually high-frequency or commercial resale manner;
• Bypass membership, points, access restrictions, security mechanisms or App Store purchase mechanisms;
• Use AI, translation, voice assessment or learning content for illegal, high-risk or inappropriate purposes.

If you violate the above rules, we may take measures such as deleting content, restricting functions, suspending accounts, terminating services, or pursuing legal liability.

4. Learning, translation, AI and voice evaluation instructions

FlowChinese's courses, translations, AI coaching and voice evaluation functions are only used for language learning and aiding understanding and do not constitute professional education, examination, legal, medical, financial, immigration or other professional advice.

AI, translation, and speech recognition results may be incorrect, incomplete, delayed, or inappropriate for a particular context. You should judge the accuracy and applicability of the output content yourself and avoid relying on it as your sole basis.

5. Subscribe to membership

FlowChinese may offer auto-renewing subscriptions, including but not limited to Basic and Premium memberships. The specific subscription name, benefits, price, period and available regions are subject to the in-app display and App Store checkout page.

Subscription benefits may include more courses, translation capabilities, AI coaching, voice reviews, or other membership features. Different membership levels may have different rights and interests, please refer to the instructions in the App for details.

5.1 Automatic renewal

If you purchase an auto-renewable subscription, payment will be charged to your Apple ID account. Subscription automatically renews unless you turn off auto-renew at least 24 hours before the end of the current subscription period.

Renewal fees are typically charged to your Apple ID account within 24 hours prior to the end of the current subscription period. You can manage or cancel subscriptions on the Apple ID subscription management page on iOS.

Deleting the app, logging out, or deleting the FlowChinese account will not automatically cancel the subscription in your Apple ID. You still need to cancel your subscription on Apple's subscription management page.

5.2 Free trials, offers and price changes

If a free trial, promotional price, discount code or price adjustment is provided, specific conditions are subject to the App Store page, in-app display and Apple checkout page.

If the subscription price changes, Apple may send you a notification or ask for your confirmation in accordance with its rules. You can also check the subscription status on the Apple ID subscription management page.

5.3 Refund

App Store purchases and subscriptions are handled by Apple. Unless otherwise required by applicable law, refund requests generally need to be submitted through official Apple channels. We are unable to process payment refunds directly to Apple accounts.

6. Points and consumable purchases

FlowChinese may offer consumable in-app purchases such as point packages. Points can be used for AI coaching, translation, voice, or other features clearly marked within the app.

After the points are successfully purchased, they will be added to your account or local rights record. Points are virtual consumption limits, cannot be exchanged for cash, cannot be transferred, and do not accrue interest.

Except as otherwise required by applicable law or Apple rules, expended points are not refundable. If points are not credited due to a system error, please contact us and provide the necessary purchase voucher information, and we will check and handle it.

7. Apple App Store related terms

If you download or purchase FlowChinese through the Apple App Store, the following rules apply:

• These Terms are solely between you and the FlowChinese operator, and Apple is not a party to these Terms;
• Apple and its subsidiaries are third-party beneficiaries of the provisions of these Terms relating to the Apple Platform;
• App downloads, purchases, subscriptions, refunds, and subscription management are governed by the Apple Media Services Terms and Conditions, the App Store Rules, and the applicable Apple terms in your region;
• The FlowChinese operator is responsible for the maintenance, support, content, services and user requests of this App, unless otherwise provided by Apple platform rules;
• If these Terms conflict with Apple's standard license agreement or App Store Rules, Apple's rules will control to the extent applicable.

8. User Content

When you use translation, AI coaching, voice practice, feedback or other interactive features, you may enter text, images, audio, feedback or other content.

You should ensure that you have the right to upload or input relevant content, and that the relevant content does not infringe the rights of others, laws, regulations or these Terms.

In order to provide services, you authorize us to process, transmit, store, analyze and display your user content to the extent necessary, such as completing translation, speech recognition, AI reply, pronunciation evaluation, error troubleshooting or customer service processing. We will handle the personal information involved in accordance with the Privacy Policy.

9. Intellectual Property Rights

FlowChinese App, interface design, code, course structure, text, images, audio, trademarks, logos and other content, except user content or third-party content, are owned by the operator or legal rights holder.

You may not copy, modify, distribute, rent, sell, reverse engineer, crawl, mirror, publicly display or commercially use relevant content without our or the relevant rights holder’s written permission.

You are granted only a limited, non-exclusive, non-transferable, revocable license to install and use FlowChinese for your own personal learning purposes.

10. Third-party services and content

FlowChinese may contain third-party logins, payments, crash analysis, performance monitoring, AI, translation, speech recognition, cloud services, or external content. Third-party services may have their own terms and privacy policies applicable.

We will try our best to select reliable service providers, but we do not make any commitment to the continued availability, accuracy, legality or security of third-party services beyond what is required by law.

11. Service changes, interruptions and terminations

We may add, modify, suspend or terminate some features based on product planning, technical, security, compliance or business reasons.

We will try our best to keep the service stable, but we do not guarantee that the service will always be uninterrupted, error-free or completely secure. We will handle any service interruptions caused by networks, equipment, systems, third-party services, force majeure, maintenance upgrades or regulatory requirements within a reasonable scope.

You can stop using FlowChinese at any time, or apply to delete your account within the app. Deleting your account is not equivalent to canceling your Apple subscription. Please handle it separately on the Apple ID subscription management page.

12. Disclaimer

To the maximum extent permitted by applicable law, FlowChinese is provided on an "as is" and "as available" basis. We make no express or implied warranties:

• The service will be completely uninterrupted, error-free, bug-free or permanently available;
• Learning, translation, AI, speech recognition or evaluation results are completely accurate;
• The service must meet your specific learning goals, exam goals or professional purposes;
• Third-party services are always available or may not change.

These Terms do not limit the mandatory rights of consumers under applicable law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, punitive, or consequential damages arising out of the use of or inability to use FlowChinese.

If the law requires us to be liable, our total liability will be capped at the amount actually paid by you for the FlowChinese Services in the twelve months prior to the dispute arising, or, if you have not paid any fees, at the minimum permitted by applicable law.

14. Privacy Protection

We will handle your personal information in accordance with the FlowChinese Privacy Policy. The Privacy Policy is an integral part of these Terms.

15. Minors

If you are a minor, you should use FlowChinese with the consent and guidance of your guardian. Guardians should manage the usage and purchasing behavior of minors.

If the law requires the consent of a guardian to use certain functions or purchase services, you should obtain the appropriate consent before using it.

16. Governing Law and Dispute Resolution

The formation, validity, interpretation, performance and dispute resolution of these Terms shall be governed by the laws of the location of the operator, but this does not exclude the non-excludable mandatory rights granted to consumers by the laws of your country or region.

Any dispute arising out of these Terms or FlowChinese Services shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party may file a lawsuit with a court with jurisdiction where the operator is located, or resolve the dispute in other ways permitted by applicable law.

If the law of the country where you are a consumer gives you non-excludable rights, these Terms will not limit those rights.

17. Terms Update

We may update these Terms from time to time. After updating, we will provide a new version of the Terms on the App, official website or App Store page, and update the effective date.

If the changes have a significant impact on your rights or obligations, we will remind you in an appropriate manner. Your continued use of FlowChinese after the terms are updated means that you have understood and accepted the updated terms.
